TERMS OF SERVICE

By agreeing to the Terms of Service, you desire to engage pet care and to obtain the care and services provided and offered in this agreement. Woofs Wags & Wiggles agrees to provide services in accordance with the Terms of Service as follows:

Daycare & Boarding Agreement

By agreeing to the Terms of Service, you authorize Woofs Wags & Wiggles to perform the services as set forth herein and in the price sheet provided to you (the “price sheet”) for the time period(s) as requested by you (“scheduled period”). During any scheduled period, fees for services will be calculated pursuant to the price sheet, which may be modified from time-to-time in its sole discretion.

Emergency Veterinary Service Release

In the event of an emergency (ex, injured pets, severe weather, broken pipes, natural disaster, fire, etc.), Woofs Wags & Wiggles is authorized to take all measures deemed necessary or advisable in its sole and absolute discretion in caring for Pets (including without limitation emergency veterinary care for Pets and other emergency services to ensure safety and survival. By accepting the Terms of Service, you agree to defend, indemnify and hold harmless Woofs Wags & Wiggles from all liabilities, claims and expenses, including reasonable attorney fees, that arise from or relate to such decisions. In the event of such an emergency, You will be responsible to immediately reimburse Woofs Wags & Wiggles for expenses incurred, plus any additional fees or expenses for attending to such an emergency. This authorization shall continue indefinitely, and apply to all future services, as long as you agree to the Terms of Service.

Required/Recommended Vaccines

The health and safety of your pet is Woofs Wags & Wiggle’s top priority. Please review our requirements and be sure your dog is up to date before his or her next visit to our facility. Woofs Wags & Wiggles reserves the right to accept or reject your dog from our services depending upon our review of its vaccination status.

  1. Distemper (required)

    • 1 or 3-yr. vaccine required.

    • These shots cover canine distemper, hepatitis, leptospirosis, parainfluenza and parvovirus. Distemper may appear on your records as just that, or in a combo shot such as DHPP or DHLPP.

  2. Bordetella (required)

    • Required every 12 months. However, Woofs Wags & Wiggles recommends every 6 months to ensure maximum efficiency & protection against Kennel Cough.

  3. Rabies (required)

    • 1 or 3-yr. vaccine required.

  4. Canine Flu - H3N2 & H3N8 (recommended)

    • Canine flu is a relatively new canine disease. There are two strains and dogs do not have any immunity before their first exposure. It is highly contagious.

  5. Flee & Ticks (required)

    • In addition to vaccinations, all dogs should be flea and tick free and equipped with proper preventive methods such as frontline or the seresto collar.

By agreeing to the Terms of Service, you represent and warrant that your pet(s) are currently vaccinated in accordance with all local and state laws and regulations. You agree to indemnify, defend, and hold harmless Woofs Wags & Wiggles from all liabilities, claims and expenses, including reasonable attorney fees, that arise from or relate to your pet’s behavior, including, without limitation, property damage, personal injury, or death caused by your pet(s).

Please be sure to bring your dog(s) vaccination documents with you to your first appointment, or send them via email to Tara@WoofsWagsWiggles.com. Failure to do so will result in your dog(s) being turned away at the time of your appointment.

Credit Card Information Release

The credit card information you provide to Woofs Wags & Wiggles will be retained on file for any future invoice charges. If you would like to change your credit card information, you may do so by editing your account information while logged in through our scheduling software. By agreeing to the Terms of Service, you are authorizing Woofs Wags & Wiggles to automatically charge your card for all current and/or future services. When scheduling an appointment, the price that is listed is the price that you will pay; there are no added taxes, surcharges, or hidden fees. An email confirmation will be sent to you after each time your card is charged for our services. This authorization shall continue indefinitely, and apply to all future charges, as long as you agree to the Terms of Service.

By agreeing to the Terms of Service, you agree to promptly pay all invoices from Woofs Wags & Wiggles. Late fees, handling fees for returned checks, and other fees shall be payable as set forth in the price sheet. You are responsible for paying interest charges at the lesser rate of one and one-half percent (1.5%) per month or the maximum rate permitted by law on past due invoices. You are also responsible for all costs and fees associated with collection proceedings, including attorneys’ fees, for all amounts more than forty-five (45) days past due.

Media Release

Woofs Wags & Wiggles has the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of my pet(s) to be used in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration. You waive the right to inspect or approve any finished product in which your pet(s) likeness appears, including written or electronic copy. This authorization shall continue indefinitely, as long as you agree to the Terms of Service.

Liability Agreement

Woofs Wags & Wiggles provides no representations or warranties, express or implied, with respect to the services and disclaims of any and all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. In consideration of the services as an express condition thereof, you expressly waive and relinquish any and all claims and liabilities of any kind against the provider arising from or relating to the services or this agreement, except those arising from the gross negligence or willful misconduct of the provider. Without limiting the foregoing, in no event shall the provider be liable for any special, incidental, indirect, or consequential damages of any kind in connect with this agreement, even if the provider has been informed in advance of the possibility of such damages; in no event shall the provider total and aggregate liability hereunder exceed the amount paid by you to Woofs Wags & Wiggles hereunder.

Termination Agreement

Either party may terminate this agreement at any time, for any reason, or no reason, by providing the other party with a 2 week notice of such termination. This agreement constitutes the entire agreement between the parties in connection with the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, negotiations and discussions between the parties, whether oral or written. The validity, construction and performance of this agreement shall be governed by and construed in accordance with the substantive law of the Commonwealth of New York State without regard to conflicts of law provisions. If any provision of this agreement or the application of any such provision shall be held to be contrary to law, the remaining provisions of this agreement shall remain in full force and effect to the maximum extent permissible. The parties hereto have executed this agreement.
